Proper use of Scores and MP3 files.
If you have purchased a downloadable PDF score file, then this file is for your use, and that of your choir/school only. You must not send the file electronically to a third party, as that will infringe on the copyright of the composers and authors of the work. The exception to this rule is that you may forward the files to a secretary of your choir/school for the express purpose of making the purchased number of copies, with the understanding that the email with the attached PDF or MP3 files not be distributed beyond your organisation. If you have purchased MP3 files, such as backing or rehearsal tracks, you may distribute them to the members of your choir.
Manually issued invoices.
If you request a manual invoice for your choir or school to pay, you agree that you will be held responsible for ensuring the invoice is paid within three weeks. If your payment method fails or your account is past due, we may collect fees owed using collection mechanisms, including third party debt collection services. You agree to provide accurate information necessary for SingScore to issue manual invoices.
Website Content.
The content of the SingScore website contains files which are protected by copyright law. It is especially important for composers and authors that their copyright is protected, as this provides them with income. You agree not to copy, distribute, or modify content from the site, or use our logo without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in the website. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of the content of the SingScore website.
SingScore does not warrant that the servers that host this website will be virus or bug free and you accept that it is your responsibility to make adequate provision for protection against such threats. SingScore makes no promise that the website will operate error free or uninterrupted.
Setting up an account.
If you wish to register and set up an account with us, you will be supplying us with your email address and a password. The email address with which you register your account will be an email address that you have access to, and you take responsibility for securing and keeping the confidentiality of your password. If you believe your login details have been compromised or misused, contact us immediately at ruth@singscore.com.au.
Third Party services on SingScore.
You will use the PayPal payment gateway for financial transactions through our website. You acknowledge and agree that by utilising any third party services through our Services (such as PayPal), you are bound by the terms and conditions of that third party and we are not liable for any loss, claims, or damages arising in connection with that third party’s services.
If you have a dispute with PayPal that does not arise directly as a result of an error by SingScore, in respect of any payment transacted (or failed to be transacted) on your PayPal Account, you release us and our affiliates from any and all claims demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.
SingScore and links to other web sites.
SingScore may provide links to web sites outside of the SingScore site. These linked sites are not under the control of SingScore, and SingScore is not responsible for the conduct of such companies, nor for the performance or otherwise of any content and/or software contained in external websites.
Personal Information Provided to Us.
By using the Services, you agree to the collection, transfer, storage and use of your personal information by us. (For more information, see the Privacy Policy)
Refunds:
If files purchased from SingScore fail to be sent to the consumer after purchase, then the purchaser can apply for a full refund, or request that the files be sent again. If files are corrupted, or substantial errors are found in the files, then the purchaser can apply for a full refund, or request a revision of the files. Refunds will not be given for reasons other than the reasons described above. An application for a refund should happen within 14 days of the original purchase.
SingScore guarantees that all our files are in working order and are not damaged in any way.
Limitation of Liability.
Nothing in these Terms of Use excludes, restricts or modifies any rights or statutory guarantees that you may have under applicable laws that cannot be excluded, restricted or modified, including any such rights or statutory guarantees under the Australian Consumer Law. To the extent that these Terms of Use are found to exclude, restrict or modify any such rights or statutory guarantees, those rights and/or statutory guarantees prevail to the extent of the inconsistency.
Changes to the website.
SingScore may change, amend or remove any of the products offered on the website at any time without notice. SingScore reserves the right to make changes to any material on the website.

Whilst every effort is made to ensure that the content of this website is accurate, SingScore makes no representations or warranties in relation to the accuracy or completeness of the site’s information.
